Dismissed bank staff entitled to compassionate allowance

Bank employee dismissed, removed or terminated from service is also entitled for grant of compassionate allowance, the Punjab and Haryana High Court has ruled. Justice Kuldip Singh has also made it clear that the allowance can be maximum up to two-third of the pension that would have been admissible to the employee on the basis of qualifying service rendered up to the date of dismissal. He added that the employee need not have opted for pension for claiming compassionate allowance. The judge, in fact, brushed aside Syndicate Bank’s contention that petitioner Parmanand claiming compassionate allowance had not submitted option for pension before he was removed from service in February 1995.
