Dear Comrades,

¨Towards preparation of Charter of Demands for 11th Bipartite Wage Revision Settlement.

Units are aware that the current 10th Bipartite Settlement’s period will end by October, 2017 and the wage revision under 11th Bipartite Settlement will become due from 1.11.2017. So far, even though we have been submitting the Charter of Demands earlier, there has always been delay in concluding the Settlement due to various hurdles during the course of negotiations. This has been creating avoidable anxieties and apprehensions in the minds of members and sometimes even leading to casting aspersions on unions as though the delay is deliberate.

Hence, expediting the Settlement in a time bound manner is very imperative. It is good that the Government has advised IBA/Banks to ensure that the wage revision process is initiated early and completed well before the expiry of the current settlement. We welcome this guideline of the Government.

Mandate to IBA:

Based on this guideline, already Banks have started giving mandate to IBA with the approval of their Board. Vijaya Bank, Corporation Bank, etc.  have already given their mandate to IBA.  Few more Banks are in the pipeline.  Our All India Bank-wise Unions are requested to take up the matter with their management for giving mandate to IBA to discuss and finlaise the next wage settlement on their behalf.

Preparation of Charter of Demands:

AIBEA has already set up its Sub-Committee with Com. Lalita Joshi (Joint Secretary of AIBEA) as its Convener for preparation of the Charter of Demands and submission to IBA well in time.  As in the past, we wish to invite suggestions from all our units so that the Charter of Demands reflects the aspirations of the membership and suggestions of our unions.

All our units are requested to discuss the issue at their respective level and submit their suggestions regarding the following aspects:

New Pay Scales,
Improvement in DA and other Allowances,
Leave and holidays,
Health cover,
Other service conditions and benefits,
Duties and responsibilities,
Disciplinary procedure,
Improvement in retirement benefits, etc. etc.

All suggestions from our units should be sent to us as under:

Thereafter, these suggestions will be discussed by the Sub-Committee and their recommendations will be considered by the Central Committee of AIBEA for finalization and it would be presented in the ensuing Conference of AIBEA before submission to IBA.

Discussions held between IBA and AIBOC regarding residual issues of the 10th Bipartite Settlement

Discussions were held between IBA and AIBOC regarding residual issues of the 10th Bipartite Settlement and other issues raised before Dy CLC(C) on 08.12.2016.  AIBOC has issued circular regarding the meeting with IBA. The relevant paras to the retirees are repoduced below.

Issues covered in the Record Note on pension : We informed IBA that our demand with regard to Pension Scheme include three issues viz. (a) 100% neutralization of DA to all pre-November, 2002 retirees (b) revision in the rates of family pension (c) Upgradation of pension and demanded that IBA need to take early steps to settle those issues. IBA informed that as informed earlier they are in the process of calculation of cost by the Actuaries and they have called for certain data from all the Banks. They further informed that they have received the said data from most of the banks and that once the data is received from the remaining banks, they would calculate the additional cost and will have a view on the issues.

IBA’s Medical Insurance Scheme : We brought to the notice of the IBA that the retirees are yet to be extended the reimbursement of domiciliary treatment expenses as agreed in the 10th bipartite settlement and again in the conciliation meeting held on 08.12.2015. We also brought to their notice various types of complaints received from the retirees with regard to the cashless hospitalization facility and delayed/non-settlement of hospitalization claims by the TPAs / Insurance Company. IBA informed that they are committed to provide domiciliary treatment facility under their Insurance Scheme to the retirees and that for this purpose they had a meeting with the Insurance Company on 15.01.2016, wherein, they have made it clear to the Insurance Company that they have to extend the domiciliary treatment facility to the retirees. They further informed us that the Insurance Company has agreed to extend the deadline for retirees to opt for their Insurance Scheme upto 31.03.2016. As regards complaints of the members against the Insurance Scheme and TPAs regarding cashless hospitalization facility and settlement of hospitalization/ domiciliary treatment expenses, they have advised to submit the list of such cases to them to take up with the Insurance Company.

AIBOC GIVES A CLARION CALL FOR ONE DAY STRIKE ON 11th DECEMBER, 2015

You are aware that Joint Note for Xth Bipartite Settlement was signed on 25th May 2015, but there were many issues like the issues of Retirees covered in the Record Note, issue of disciplinary matters, calling officers on Sundays / holidays, anomaly in stagnation increments etc., which remained pending on the assurance of IBA that action required on their part on these issues would soon be taken. Despite lapse of six months and our several reminders, no steps have been taken by the IBA to resolve the issues, as per the understanding reached during the discussions. There has been no move either to start the negotiations or restart the discussions. Leave apart this, even normal courtesy of acknowledging our communications has not been shown. The settled issues of Medical aid, reimbursement of medical expenses for retired employees through insurance policy are also being denied.

Apart from this, Government, on the one hand, is announcing and implementing policies based on the recommendations of P.J. Nayak committee viz. diluting stakes in Public Sector Banks (PSBs), privatisation of banks through denial of capital required by PSBs, establishing Banking Bureau Board, deliberate delay in appointing Officer Directors on the Banks’ Boards, appointment of private entrepreneurs as MDs and Chairmen in Banks, permitting FDI in the banking sectors etc. On the other hand, no steps are being taken to recover debts from willful defaulters, providing more windows by ways of Asset Reconstruction companies and SDRs, thus providing the escape routes to the defaulters of public money.

All these issues were deliberated in the AIBOC Executive Committee meeting held at Mangalore on date. The Committee also discussed the issue of non implementation of the understanding reached between Dhanlaxmi Bank Officers’ Organisation (DBOO) and Dhanlaxmi Bank management, in the presence of Hon’ble Home Minister and trade union leaders of the Kerala state. After due deliberations, the Executive Committee of the Confederation was of the unanimous view that any delay in deciding direct action will be damaging to the very existence of the Public sector and job security of the employees. It was also the opinion of the Committee that in view of the recommendations of 7th Pay Commission, salary settlement of LIC employees, there is a need to relook into our Xth BPS accordingly. The Committee unanimously decided to give an All India strike call for 11th December, 2015 and authorized the General Secretary to issue Notice for the strike and to serve it to all concerned authorities. The central leadership was also authorized to decide preparatory action programme.

We take this opportunity to apprise you that Notice of strike has been served by mail today and copies of the same have been sent to CLC (C), Department of Financial Services, Ministry of Finance, to Chairmen / MDs of all PSBs. Notice and statement of the case are also enclosed herewith the circular.

We call upon all our Affiliates/ State Committees to warm up the rank and file and take all possible steps to ensure successful implementation of the strike call. The following action programme has also been decided as preparatory exercise for the strike:

Chief Executives of Member Banks which are parties to the Bipartite Discussions

Dear Sir/Madam,

Implementation of Medical Insurance Scheme to Retirees as agreed vide Bipartite Settlement/Joint Note dated 25.5.2015

We refer to our Circular No.CIR / HR&IR / 2015-16 / XBPS / J /1413 dated 1.10.2015 advising member banks to obtain consent of retirees expeditiously and provide details to United India Insurance Company Ltd., (UIICL) and to make Group Medical Insurance Policy operational, preferably w.e.f. 1.11.2015. 

We are informed that as on date, 13  banks have sent details of retirees and  have either paid the premium or are in the process of remitting the premium  and joined the Scheme w.e.f. 1.11.2015.
We have been receiving queries from banks, as to whether surviving spouse of the deceased employee (widow/widower) are eligible to join the Scheme. 

We are to state that since insurance premium is to be paid by the retirees/surviving spouses of the deceased employees and UIICL has  agreed to include spouse of the deceased employee, 
 Banks  may include the spouse of deceased retired employee  under the Group Medical Insurance Scheme.  Further, Bank will not incur any additional cost by doing so as Insurance Premium would be borne by the retiree/spouse. 

IBA   received  letters from few  Banks  to request the UIICL to start the Group Medical Insurance Policy for retirees  from 1.12.15 (instead of 1.11.2015) and permit them to pay  pro rata premium, as banks have not completed the process of collecting details/premiums from the retirees. 

On reference to Insurance Companies, we are advised as under: 

“In all our workshops we have been mentioning that there would be no pro rata premium for the retirees. This is so, because in case of the retirees the coverage and the premium is very competitive and is not available anywhere else. They also being covered under the policy without any medical examination and coverage  for pre-existing ailments is also available to them. They may join at a later date on pro rata and could delay hospitalisation which may have been needed in November to December or January. In this manner, though they may pay a reduced pro rata premium, the claims would be 100% and this would upset the actuarial balance of the policy.” 

In view of the foregoing, for retirees, the Policy will commence uniformly w.e.f.  1.11.2015 and they have to pay full year premium. Banks which are yet to submit details of retired employees/remittance of premium, are requested to do so at the earliest, so as to cover the retirees  from the date of payment of premium, lest they will be deprived of the benefit of coverage from 1.11.2015 till the date of payment of premium .

10th bipartite Settlement Re-open

On 25.05.2015 Full settlement signed!
Still UFBU or Individual Union has not opened their mouth and give explanation,
Why Loading on Basic Pay is restricted to 2%?
What made them to accept this proposal?

It may be recalled during 7th B.P.S., IBA has decided to delay/postpone payment of arrears to three Banks viz. Indian Bank, UCO Bank, United Bank.
Only BEFI has objected it, and refuse to sign the settlement.
BEFI has signed the settlement only after IBA agreed to pay arrears to these Banks along with 
other Banks. 
What happened to BEFI now?
No circular justifying the decision of loading on Basic Pay is issued till date. 

After signing of settlement, IBA has announced some clarification contrary to the provisions 
already agreed on the plea of “omitted”.

2nd and 4th Saturday Leave has not been implemented till date.

Some Banks asked for undertaking from retired employees to give option on Increased 
Commutation arrears. On seeing the arrears chart for pensioners, they are shocked. 
Though some of the pensioners know this from social media, others who are not in social media are disappointed on knowing that pension is being reduced and a portion of pension paid is to be recovered. .

From the comments, feedback from employees from my Face book page and Blog, 
I place the following demands on behalf of employees and request UFBU to demand for reopening the 10th B.P.S. and make the following changes to avoid anomaly.

X BP SETTLEMENT – CLARIFICATIONS

1. Paternity Leave:

Clause 32 of the X Bipartite Settlement provides the benefit of Paternity Leave w.e.f.
1.6.2015 to male employees with less than two surviving children for 15 days during his
wife’s confinement and may be combined with any other kind of leave except Casual Leave.
The leave may be availed upto 15 days before or upto 6 months from the date of delivery of
the child.

Clarifications: The leave may be granted to an employee even where the date of delivery of
the child was prior to 1.6.2015, provided, however, that the leave is availed within six
months from the date of delivery. Further, the leave shall be sanctioned 15 days before the
delivery or up to 6 months after the delivery.

2. Leave Fare Concession:

Clause 19 (iv) of IX Bipartite Settlement dated 27.4.2010 provided that an employee
encashing the facility of Leave Fare Concession shall proceed on leave for a minimum period of one day.

Clarifications: Clause 19 (iv) of X Bipartite Settlement dated 25.5.2015 does not have this
provision and hence with effect from 1.6.2015, employees may be allowed the facility of
encashing of Leave Fare Concession without the requirement of availing Leave for this
purpose.
